1. Objection to junction

If you recall, after receiving the letter dated 17th August 2005 from MBSA (stating the junction can be used up to 6 months but within 1 ½ years), the GCHA Exco filed in an appeal to the Selangor Appeals Board on the 15th September 2005 to close the junction. As a “plan B”, the GCHA Exco also decided to request Fernandez & Selvarajah Advocates & Solicitors – a firm specializes in land and planning matters – to prepare and eventual file in a legal action to challenge the decision of MBSA.

GCHA Exco sent in a Letter of Clarification to MBSA on the 5th September 2005 and our Property Manager was instructed to “sit” in Datuk Bandar’s office and request for an urgent meeting.

On the 20th September 2005, the Selangor Appeals Board rejected our application.

However, on the 22nd September 2005 Datuk Bandar granted GCHA Exco members with a meeting in response to our Letter of Clarification. The scheduled meeting went on very well and Datuk Bandar was most sympathetic to our requests. The meeting ended with Datuk Bandar promising that MBSA will close the junction after 6 months and GCHA Exco members present agreed to the decision understanding that MBSA has previously (on the 19th July 2005) given Horsedale Development Bhd (Horsedale) the permission to use the junction for the temporary access road for 6 months.

Recently we received MBSA’s letter dated 27th September 2005 Ref. MBSA/J/Infra/Sek.13/171-2001. A copy of the letter and the translation are attached herewith for your reference.

In summary, para 4 of the said letter from MBSA requires Horsedale to close the junction after 6 months from the 17th August 2005 and in the meantime, within the same period, to submit plans and construct a permanent access road. Besides that, Horsedale is required to put up signages to prevent heavy vehicles from using the junction, enlarge the junction and put in flexible poles to guide traffic. MBSA has promised to take drastic action should any accidents happen at the junction and to this end, GCHA has put up a CCTV camera to monitor all traffic movements within the junction especially traffic using the new access road.

At this stage, GCHA Exco is recommending all Glenmarians to accept the decision made by MBSA in their letter dated 27th September 2005 and the Exco will be issuing a letter to thank Datak Bandar for his decision. However, residents who are not happy with the MBSA decision and want the junction to be close immediately can write in individually to Datuk Bandar.

2. Security & Safety

At last the Perimeter Beam Detector (PBD) system for Glenmarie Court is finally completed and commissioned.

The Phase I PBD system, which is for the bungalows facing the Glenamrie golf course, was completed and commissioned in February 2005. The Phase II PBD system for the balance of the area i.e. from the guardhouse along the perimeter fencing (Jalan U1/6B) to Jalan U1/11A where the guard dogs are kept, was completed and commissioned and handed over on the 7th September 2005

Phase I

Phase I

Phase II

Phase II

What this means is the whole perimeter of Glenmarie Court is now protected by the PBD system. When the beam is broken, security of Glenmarie Court is breached. The mimic board (which shows the layout plan of Glenmarie Court in 60 zones and placed in the guardhouse) will show the breached zone and our guards together with our dogs and the dog handlers will response to the call within 5 minutes of the alarm.

The PDB system is automatically switched on at 9.30pm till 7.00 daily. It is tempting to just pace your hand at the face of the detector (which is either a transmitter or receiver) to breach the security and raise an alarm at the mimic board. But if this happens too many times, the guards will let their defenses down and a “cry wolf” situation will arise. So please do not let this happen.

19.9.2005

Dear Glenmarians,

OBJECTION TO THE CONSTRUCTION OF JUNCTION TO NEW ACCESS ROAD CONSTRUCTED BY HORSEDALE DEVELOPMENT BERHAD

The long awaited letter from MBSA signed by the Pengarah Kejuruteraan dated 17th August 2005 (ref. MBSA/KEJ/KI/600/IF/Sek.U1/293-2005) was finally received by GCHA on the 30th August 2005 (after many requests).

Regretfully, the contents of the letter (view MBSA_letter.pdf) (translation of letter) is not correct and not reflective of the conclusion made by YB Datuk Bandar on the day of the meeting on the 15th August 2005 which was attended by GCHA Exco members and representatives from Horsedale Development Bhd.

The GCHA Exco have deliberated on the contents of the letter from MBSA during our meeting on the 5th September 2005 and have decided to seek clarifications from Datuk Bandar, seek legal opinion to protect the rights of the residents of Glenmarie Court and to appoint an Independent Engineer to assess the safety of the junction.

A letter dated 5th September 2005 was handed to Datuk Bandar’s office (Copy is attached herewith). No reply was received until now.

Ex-gratia legal advice was obtained from Sri Kumar, a resident of Glenmarie Court and consequently an appeal was filed to the Appeal Board of Jabatan Perancang Bandar Dan Desa Negeri Selangor by the GCHA. This was filed in on the 15th September 2005. We are currently awaiting their response. Meanwhile, we are also looking into other legal options and non-legal options available to residents.

In the meantime, Horsedale have every intention to finish the construction of the junction, which they did on the 15th September 2005.

From the road features of the junction, the egress lane from Glenmarie Court is constricted immediately after the junction, and there is also a right turn from the new access road into the ingress lane from Glenamrie Court. These may be dangerous to our residents. Residents are advised to be very careful when using our access road, Jalan Presiden U1/1. See photographs attached.

Issued by GCHA Exco.

29.8.2005 - Update!

Since our latest updates and breaking news on the 8th August 2005, we were scheduled to meet Datuk Bandar of MBSA on the 9th August 2005 but was later postponed to the 15th August 2005. The meeting held in Datuk Bandar’s office was attended by representatives from Horsedale, the Deputy President of MPP Zone 3 and our Exco Members.

Presentations were made by Horsedale who elaborated that the access road to their office will only be used by their staff (about 14) and visitors for 1 ½ years whilst their new office (which will be located at the corner of a row of 36 shop-offices due to be launched in September 2005) is being constructed. They will close the junction in front of the guardhouse thereafter. Horsedale is therefore requesting Datuk Bandar to allow them to use the junction for 1 ½ years instead of the MBSA’s approval as a temporary junction for 6 months only.

GCHA commented that the present junction leading to the new access road constructed by Horsedale is dangerous, both to the public and the residents who frequently use the access road to Glenamrie Court. More than 80% of the residents in Glenamrie Court are objecting to the junction. GCHA further commented that 1 ½ years is a long time and many accidents could happen by then.

Horsedale should use the present access (next to the Caltex Station) by enlarging the access to accommodate construction vehicles (during the construction of the shop offices) rather than to construct a new access with a dangerous junction. Enlarging the access next to the Caltex Station will eventually be used by Horsedale to their new office. Photograph showing that enlarging the present access road can be carried out was shown to Datuk Bandar.

Datuk Bandar concluded after listening to both parties that:-

  1. MBSA will allow Horsedale to use the junction for a period of 6 months only but the junction must be enlarged according to the drawing proposed by Horsedale’s consultant, with a storage lane to accommodate right turning vehicles and streamline the concrete kerbs to allow free flow of traffic for the residents both entering and exiting Glenmarie Court. Other safety features must be provided to prevent accidents.
  2. The junction will be closed after 6 months, but in the meantime, Horsedale must submit planning proposal for their future development (beside the proposed shop-offices) including an access road for their staff and visitors. They are required to commence and complete constructing the alternative access road to the present Horsedale’s office within this 6 months period.

Datuk Bandar promised to issue this directive to Horsedale copied to GCHA “immediately”.

To date, in spite of frequent requests, the letter has not been issued by MBSA and the latest was a promise by the Pengarah of MBSA that they will fax the letter to GCHA by 4.30pm, 24th August 2005. This was not received.

In the meantime, we can only advice our residents and their friends to be careful when exiting Glenmarie Court. We have used our plastic barriers to streamline the traffic flow to avoid knocking into the “nose” of the central divider constructed by Horsedale.

Be patient and be careful please whilst we try to resolve this issue.

8.8.2005 - BREAKING NEWS!!!

5th August 2005

The meeting (called by MBSA on the 1st August 2005) between MPP Zone 3, MBSA, Horsedale Development Bhd (Horsedale) and GCHA took place as scheduled at 10.05am on the 5th August 2005.

Meeting between MBSA, GCHA Exco members, Deputy President of MPP Zone 3 and Horsedale on the 5th August 2005 at the junction of the new access road

During the meeting, GCHA Exco members expressed that 127 residents or 80% of the residents in Glenmarie Court have signed the Objection Letters to YB Datuk Bandar, appealing MBSA not to open the junction which is dangerous to both residents of Glenmarie Court and the public.

In reply to our statement, Horsedale’s representative Mr Yew mentioned that “the junction is not dangerous and is only deemed dangerous when accidents happen”. We find this remark both irresponsible and arrogant coming from the representative of a reputable developer.

The access road was constructed by Horsedale without first getting MBSA’s approval. Application was only made on the 11th July 2005 when both the access road and the junction were almost completed. MBSA suggested allowing Horsedale to use the temporary access road for 6 months allowing Horsedale to seek alternative access to which GCHA replied that Horsedale already have two (2) access roads to their office next to the existing Caltex Station and the orchid farm.

When requested to confirm whether the new access road is temporary, Horsedale mentioned that they have spent over “one hundred thousand ringgit for the access road” and is unlikely to be temporary.

Deputy President of MPP Zone 3 requested to defer the meeting and allow both MBSA and Horsedale to deliberate further. GCHA Exco members requested MBSA to take into consideration the view of 80% of the residents in Glenmarie Court and close the junction permanently.

6th August 2005

Shocking!

One day after the scheduled meeting with MBSA on the 5th August 2005, Horsedale went ahead to complete the junction by removing our plastic barriers and constructing the centre divider with concrete curbs.

Whether they have permissions from MBSA to do that is not clear, what is clear is they are not “listening” to our objection to the junction.

Completing the junction in front of the guardhouse on the 6th August 2005

30.7.2005

On the 23rd July 2005, GCHA Exco met to deliberate on the issues arising from the construction of the junction for the access road to Horsedale’s office. Horsedale have not responded to both our letters dated 4th July 2005 and 11th July 2005. All Exco members are in the opinion that enough time has been given to Horsedale to respond to our requests on whether the incoming access road to the guardhouse will be widen to accommodate residents’ vehicles to avoid waiting for cars to turn right into the new access road to Horsedale office and to confirm the new access road will not be used for construction purposes for their future development....click here for more.

23.7.2005

Four (4) representatives from MBSA visited the site on the 20th July 2005 together with our Property Manager Mr Simon Teoh, En Ruslan from Horsedale and Ms Dolly from Zaidun-Leeng Sdn Bhd.

The following comments were noted by our Property Manger.
  1. The application to construct the road was submitted to MBSA on the 11th July 2005. MBSA made a reply on the 19th July 2005 stating the road is only for temporary use for 6 months only, from the date of their approval. However, construction of the access road started before application to MBSA.
  2. When queried by MBSA, En Ruslan from Horsedale confirmed that the access road is for the staff and visitors only and not for construction purposes. MBSA thereafter suggested Horsedale to put up a barrier to prevent construction lorries from using the road.
  3. MBSA required proper protection to the slops and road surface to avoid soil erosion and eventual clogging of the main drain.
  4. No proper signage was placed prior to commencing of construction.
  5. MBSA requested resubmission of the access road for their comments.
  6. In the meantime, MBSA instructed Horsedale not to complete the construction of the junction and break the road kerbs until they receive further comments from MBSA.

Alternative access road to Horsedale

Prior to the construction of the central divider along Persiaran Kerjaya, staff from Horsedale goes to work using the road next to the orchid farm situated at the corner of Persiaran Kerjaya.

Road beside orchid farm

When the central divider was installed by JKR Malaysia in July 2004, Horsedale staff uses the road beside the Caltex Station to work.

Road beside Caltex Station

With the forthcoming launch of the commercial centre next to the Caltex Station, this road will be closed and Horsedale have designed an alternative road to their office using the junction in front of our guardhouse as the access.

View of access to road leading to Horsedale

The 1st junction proposal by Horsedale was a roundabout, the drawing of which was displayed during our recent AGM on the 26th March 2005. GCHA requested for the junction to be pegged out prior to construction (see letter dated 6th June 2005 from GCHA).

Horsedale changed their junction details to a T-junction recently and details were given to GCHA lately on the 2nd June 2005.

We wrote to Horsedale requesting them to incorporate a wider lane at the corner of the entry to the guardhouse so that residents will not be obstructed by cars waiting to turn right into the access road to Horsedale (see letter dated 4th July 2005 from GCHA).

We have informed Horsedale that the construction of the junction near the guardhouse should not commence until the details are finalized and approved by GCHA (see letter dated 11th July 2005).

2.2 Protection to palm trees

Five palm trees were recently attacked by rhinoceros beetles. On the advice given by FRIM, GCHA appointed a pest control company to place traps for the beetles. This process is known to be the only proven remedy/protection for the palm trees. The source of the beetles were detected to originate from the dead branches left by GGCC after maintenance. Since then, they have cleared the debris after complaints by our Chairman Landscape Committee.

4. Other Issues

4.1 Animal (Pets)

Lately our Property Manager received a lot of complaints left for defrosting or just bought from market were missing. At the request of the residents, GCHA decided to appoint a Pest Control Company to place traps at strategic points at the common area. Stray cats that are caught will be sent to Animal Home (RSPCA) in Klang.

ALL RESIDENTS ARE ADVISED TO KEEP THEIR PETS ESPECIALLY CATS IN THEIR HOMES TO PREVENT THEM FROM GETTING CAUGHT IN THE TRAPS.

4.2 Domestic Complaints

Recently, our Property Manager also received a lot of domestic requests to help our residents. Some of the common domestic requests are:

1. Requesting neighbours to tone down the radio;

2. Prevent maids from talking to another maid (neighbour)

This kind of requests cannot be handled by our Property Manager and we are requesting our residents to refrain calling our Property Manager on domestic affairs and disagreements with their neighbours.

29.03.2005 - LATEST UPDATES ON GLENMARIE COURT

A lot has been said and discussed on the issues of rearing dogs (both as pets and guard dogs) in Glenmarie Court, the use of residents’ access cards and registration of visitors at the entry gate.

The issues on dogs are manifold but the main issues are:-

1. Walking the dogs

  • Some owners seldom walk their dogs and leave the responsibilities to their maids or children.
  • Sometimes dogs are let out to roam around Glenmarie Court, unleash.
  • Others jog around Glenmarie Court and their dogs follow – again unleash.
  • Occasionally guard dogs, which are kept in the compound for days, are accidentally let loose when the gates are opened. There are reports that residents of Glenmarie Court have been sniffed by the dogs, suffered minutes of trauma and kept very still (in fear) to avoid a possible attack. Children may not have the presence of mind to do so.

2. Dogs’ shit

  • Dogs, who were either taken for a walk or let loose, “shit” at their convenience in Glenmarie Court.
  • Taking a morning walk or an evening jog in Glenmarie Court is no longer a pleasure and has to possess the necessary “skills” to avoid stepping on a pile of dog’s shit. The nasty memory of the sighting can linger on during either breakfast or dinner time.

3. Rearing dogs

  • Dogs are reared as pets or guard dogs to the pleasure of the owners. But if they bark at night when unattended, this becomes a nuisance to their neighbours. There are many occasions when residents in Glenmarie Court reported their neighbours’ dogs constant barking in the middle of the night, waking them and spoiling their much needed sleep and rest.

On the matter of residents’ access cards and registration of visitors to Glenmarie Court, the main issues are:-

1. Residents allowing others to use their access cards.

2. Residents who sometimes forget to carry their access cards or refuse to carry their access cards, use the visitors’ lane for entry to Glenmarie Court without registration and demand the guards to open the gate for them.

3. Visitors who refuse to register at the entry gate

The GCHA Exco has deliberated on the above issues at length in the light of feedbacks and opinions from the residents in the recent AGM held on the 26th March 2005 and in line with the recent media reports on innocent children bitten by ferocious dogs and the recommendation given by both Subang and Sepang Municipal Councils and in consultation with Group 4, we wish to implement the following :-

Walking the dogs and dogs’ shit

1. All dogs in Glenmarie Court must be licensed by MBSA.

2. Owners or dog-minders are encouraged to walk their dogs. A dog-minder is someone trained to walk the dog and can control the dog.

3. Owners or dog-minders are required to carry plastic bags to pick up the dogs’ “shit” and dispose them in their own disposal bin.

4. The patrolling guards from Group 4 may stop your dog if the dog is not walked by the Owners or dog-minders and politely but firmly insist the dog to taken back to their compound. If Owners or dog-minders walk their dogs without plastic bags, they may be requested by the security guards to get one before they are allowed to continue with the walk.

5. Residents who suffer from constant barking from their neighbours’ dogs can report in writing to our Property Manager who will then forward the report to MBSA for further action. But to encourage good neighbourliness, our Property Manager will talk to the Owners first and solve the issue before making the report.

6. Owners, who accidentally let their guard dogs loose and are reported by residents, will be cautioned by the security guards from Group 4 and if necessary, report will be made to MBSA for action.

Residents’ access cards and registration at the entry gate

1. Residents are advised not to allow others to use Glenmarie Court access cards. It is a mockery to the security system provided by Group 4 which GCHA is paying RM27,500 per month if this is done by residents to convenient others to enter Glenmarie Court.

2. To avoid a double standard of security at the entry gate, residents who forget to bring their access cards or residents who do not wish to carry their access cards are termed as visitors and will have to use the visitors’ lane for entry.

As such, they are required to register at the entry gate of the guard house and the guards are instructed not to allow entry if registration is not carried out. To avoid any unpleasant incidents, residents are advised to register.

3. Visitors who are bringing back residents of Glenmarie Court have to register at the entry gate of the guard house, in order to gain exit from Glenmarie Court later.

The above seems a bit harsh especially for dog owners, but these regulations are made in the interest and welfare of the majority of Glenmarie Court residents. In short, if you wish to rear dogs, you have to be responsible for your dog.

We welcome your opinions through our website at www.gcha.com.my prior to the implementation date on the 15th May 2005.

GCHA – 3rd AGM

The 3rd GCHA AGM was held successfully but not responsively on the 26th March 2005 in the Ballroom, Pan Pacific Hotel. A lot of last minutes phone calls were necessary to make up a quorum of 16 residents.

Barring that the AGM was held on a Saturday afternoon after a heavy rain, the turn up was pathetic in spite of reminders and a banner. In the end only a few benefited from the well prepared presentation made by the Exco members.

The question is whether Glenmarians are committed enough to their association - GCHA and if so, then every effort should be made to attend the AGM which, after all, is held only once a year for their benefit.

GCHA – Annual Dinner & Dance “Wild Wild West”

The response to the GCHA Annual Dinner & Dance to be held on the 21st May 2005 with the “Wild Wild West” theme is tremendous. Thanks to Gillian, so far 15 tables are sold.

The evening promises to be very exciting and those still contemplating should get their tickets. See ya there on that night!

29.03.2005

SNAKES

We have received reports from some residents that there are snakes in their compound. We have deliberated this and one of the prevention is to put sulphur along our perimeter fence. This may not be practical as the rain may wash it away and sulphur is dangerous to our children and pets.

However Individual house owners can put sulphur along the perimeter of their compound, but sulphur is dangerous to children. If you wish to prevent snakes form entering your house, use this method with caution.

Our Property Manager, Simon, can be contacted at 012-6051080 for further discussion.

FIRE HYDRANTS

On the 16th March 2005, Bomba was invited to check all fire hydrants inside Glenmarie Court. Out of 32 hydrants, only 8 are functioning and the rest are either fill with mud and cement or plants.

For the general safety of Glenmarie Court, GCHA has decided to clear and expose the fire hydrants and we need your full cooperation.

New Property Manager

Encik Azlan Ismail, who has been our Property Manager for the last 2 years, tendered his resignation sometime in January 2005. His resignation was accepted by the GCHA Exco and his last day in GCHA was on the 28th February 2005. We all wish him well in his future undertaking.

Meanwhile, we have advertised the position which attracted 83 applicants. The process of finding a suitable candidate within budget took sometime, but we have finally selected and accepted Mr Simon Teoh to be the new Property Manager. Mr Simon Teoh started work in GCHA on the 25th February 2005 and he can be contacted at 012-6051080.

Annual General Meeting 2005

The next AGM for GCHA is scheduled to be on the 26th March 2005 at 2.30pm sharp at Ballroom 1, Pan Pacific Glenmarie. All residents are requested to attend the AGM where some important decisions will be made. (see Agenda) This will be followed by the GCHA Annual Dinner, a must look forward event by the residents of Glenmarie Court. The theme for this year's dinner is "Wild Wild West".

17.01.05 - Updated!

1. Outbreak of Dengue

Dear Glenmarians,

You should have by now read about the outbreak of dengue recently in Malaysia with Selangor and Kuala Lumpur leading with the highest number of cases.

The average weekly number of dengue cases is more than doubled last week. These figures showed a massive jump from 450 to about 1,000. The rise was sharpest in Selangor - from 120 cases a week to 350 - while in Kuala Lumpur it shot up from 100 to 250.

Glenmarie Court is also a potential area for Aedes breeding grounds with about 10 sites under construction. GCHA Exco has instructed our Property Manager to inspect each site daily to check for stagnant water, a potential breeding source.

On our own, we should also clean up all drains and ensure our compounds are clean and get rid of flower pots and containers which contain stagnant water (see pictures).

Let's keep Glenmarie Court a healthy and clean place to live in.

2. Security and Safety

Group 4 has commenced with the installation of the perimeter defense system using beam detectors. Trenching works for Phase I (around the bungalow areas) started on the 14th January 2005 (see picture).

3. Objection to Reopenning of Subang Airport.
